Blue Energy – Terms of Service

1. General Provisions & Entities
This website is operated by Blue Energy LLC (for US-based transactions) and Blue Energy SAS (for Colombia-based transactions), collectively referred to as “Blue Energy.” By using this site, you agree to these Terms.

2. Product Safety & Professional Installation

  • Hazardous Materials: Solar inverters and high-capacity batteries are inherently hazardous. Blue Energy sells equipment only and is not responsible for installation.
  • Qualified Persons Only: You agree that all products will be handled and installed by qualified electrical professionals. Blue Energy is not liable for injury, death, or property damage resulting from improper use or installation.

3. Professional Installation Rebate Program

  • Eligibility: Systems must be purchased in a single sale, totaling at least $5,000 USD (or COP equivalent). The system must include a Blue Energy inverter, battery, and our proprietary wiring/busbars.
  • Verification: To receive the rebate (return of installation costs), customers must provide 5 photos of the install, the certified installer’s invoice, proof of payment, and the signed Blue Energy Installer Checklist.
  • Discretion: Blue Energy reserves the right to deny rebates if the installation does not meet our safety checklist standards.

4. Shipping, Title, and Risk of Loss

  • Delivery: For the US, we use standard carriers (UPS/FedEx). For Colombia, we comply with Law 2439 of 2024, guaranteeing delivery within 30 business days unless a pre-order timeline is agreed upon.
  • Risk: Risk of loss passes to the buyer upon delivery to the carrier.

5. Returns & Right of Withdrawal (Retracto)

  • US Sales: Returns are accepted within 30 days for unopened items (subject to a restocking fee).
  • Colombia Sales: Under the Right of Retracto, customers have 5 business days from delivery to cancel the purchase for a full refund.

6. Warranty & Limitation of Liability

  • Victron Warranty: Products carry the manufacturer’s 5-year warranty. Blue Energy acts as a facilitator for claims but does not provide the warranty directly.
  • Liability Cap: To the maximum extent permitted by law, Blue Energy’s total liability for any claim is limited to the amount paid for the specific product.

7. Governing Law & Dispute Resolution

  • US: Disputes are governed by the laws of [Your US State] and resolved via binding arbitration.
  • Colombia: Disputes are governed by Colombian law and handled by the Superintendence of Industry and Commerce (SIC).
